Privacy Policy
Last updated: 13 October 2026
This Privacy Policy explains how Dead Colour ("we", "us", "our") collects, uses and protects your personal information when you visit the artist websites and storefronts we operate, place an order, or sign up to receive communications from an artist.
Dead Colour is a New Zealand-based business that works in partnership with artists to operate their online storefronts and provide e-commerce, marketing and administrative services. The artist remains the customer-facing brand, while Dead Colour operates the underlying website, systems and services.
This policy applies across the artist storefronts operated by Dead Colour unless a specific site states otherwise.
1. Information We Collect
We collect information you give us directly, as well as some information automatically when you use our sites:
Contact details — name, email address, shipping and billing address, and phone number.
Order information — items purchased, order value, payment status and information relating to fulfilment. Full payment card numbers and security codes are processed by our payment providers; we do not directly receive or store your full card details.
Newsletter sign-up details — email address, subscription status and any preferences you provide.
Communications — messages you send us through contact forms or email.
Marketing and engagement information — interactions with emails, advertisements and our websites, such as emails opened or clicked and pages or products viewed.
Technical data — IP address, approximate location (country) derived from your IP address, browser type, device information and website activity collected through cookies and similar technologies.
You do not have to provide personal information to us, but without certain information we may not be able to process an order, respond to an enquiry or provide a service you request.
2. How We Use Your Information
We use your information to:
- Process and fulfil orders, including shipping and customer support.
- Respond to enquiries sent through our websites or by email.
- Send order confirmations, shipping updates and other transactional communications.
- Send newsletters, release announcements and other communications from the artist whose storefront you signed up through.
- Operate and improve our websites, storefronts and customer experience.
- Show prices, currency and shipping information relevant to your country, based on your approximate location.
- Deliver, personalise and measure advertising and marketing for the relevant artist, including remarketing to people who have visited our websites or interacted with the artist.
- Analyse website, sales and marketing performance.
- Prevent fraud, protect our systems and comply with legal obligations.
3. Artist Communications and Dead Colour's Role
When you sign up through an artist's storefront, your subscription is primarily for communications from that artist. For example, if you sign up through an artist's website, you may receive that artist's release announcements, early access, studio updates and related communications.
Dead Colour operates the systems and marketing services used to manage these communications and may access and process subscriber information on the artist's behalf.
The relevant artist or their studio may also have access to information collected through their storefront where reasonably necessary for customer service, order fulfilment, artist communications or management of their customer relationship.
Dead Colour does not use an artist's mailing list to directly market unrelated Dead Colour artists to you unless you have separately agreed to receive those communications.
If an artist stops working with Dead Colour, information relating specifically to that artist's customers and subscribers may, where permitted by law, be transferred or made available to the artist or their studio so they can continue providing customer support and the artist communications you signed up to receive. Dead Colour may retain information where necessary for legal, accounting or legitimate business requirements.
You can unsubscribe from marketing emails at any time using the unsubscribe link included in each email.
4. Sharing Your Information
We share personal information only where reasonably necessary to operate our websites, fulfil orders, provide artist services or conduct the activities described in this policy.
Recipients may include:
The relevant artist or their studio — where necessary to manage customers, orders, enquiries and artist communications.
Shopify and payment providers (including Shopify Payments, Shop Pay and PayPal) — for storefront operation, checkout, order processing, payment handling and fraud screening.
Klaviyo — for email delivery, subscriber management and marketing communications.
Website hosting and infrastructure providers (such as Cloudflare) — for hosting and securely delivering our websites, which involves processing technical data such as your IP address and approximate location.
Shipping, printing and fulfilment providers — including postal services and couriers (such as Australia Post, DHL and UPS) and shipping platforms (such as Easyship and Starshipit), where necessary to produce, deliver or support an order.
Customs and tax authorities — for international orders, your name, delivery address, contact details and order details (such as item description and value) are provided to customs authorities in the destination country, and to tax authorities where required for GST, VAT or similar taxes.
Analytics and advertising providers — where used to understand website activity, measure marketing and deliver relevant advertising for the artist.
Professional advisers or authorities — where reasonably necessary to obtain professional advice, enforce our rights or comply with legal requirements.
These providers receive only the information reasonably required to perform their role.
We do not sell or rent your personal information.
5. Cookies and Similar Technologies
Our websites use cookies and similar technologies to operate essential website features, remember preferences, understand how visitors use our sites, measure marketing and, where used, deliver relevant advertising.
Some cookies are provided by third-party analytics or advertising services.
You can control cookies through your browser settings and, where required, through the cookie controls provided on our websites. Disabling some cookies may affect website functionality.
6. International Data Transfers
Some of the service providers we use, including Shopify, Klaviyo and Cloudflare, may process or store personal information outside New Zealand.
Artists and their studios may be based outside New Zealand (for example, in Australia), and orders may be fulfilled from the country where the artist is based. Information needed to fulfil your order, such as your name, contact details and delivery address, is shared with the artist or their studio in that country.
For international orders, shipping and customs information is also disclosed to the carriers delivering your order and to customs authorities in the destination country, as required to deliver it.
Where an overseas provider processes information on our behalf, we remain responsible for the information we hold and take reasonable steps to work with reputable providers that maintain appropriate privacy and security protections.
Where personal information is disclosed overseas for another organisation's own purposes, we take reasonable steps to ensure appropriate protections are in place as required by applicable privacy law.
7. Data Retention
We keep personal information only for as long as reasonably necessary for the purposes described in this policy or to meet our legal obligations.
Order, transaction and accounting information may be retained for the period required by applicable tax, accounting and other laws.
Marketing and subscription information may be retained while you remain subscribed, or as necessary to maintain a record of your subscription preferences and requests.
When information is no longer required, we take reasonable steps to delete, anonymise or securely dispose of it.
8. Data Security
We take reasonable technical and organisational steps to protect your information from unauthorised access, loss, or misuse. No method of transmission or storage is completely secure, but we work with reputable providers who maintain strong security practices.
9. Your Rights
Under the New Zealand Privacy Act 2020, you have the right to request access to the personal information we hold about you and to request correction of that information if it is inaccurate.
Depending on where you live, you may have additional rights under applicable privacy laws.
You can also:
- Unsubscribe from marketing communications at any time using the unsubscribe link in the email.
- Ask us to delete personal information we hold about you, although we may need to retain certain information for legal, accounting, fraud-prevention or other legitimate purposes.
- Contact us if you have a concern or complaint about how your personal information has been handled.
If you are not satisfied with how we deal with a privacy concern, you may also have the right to make a complaint to the relevant privacy regulator, including the New Zealand Office of the Privacy Commissioner.
10. Children's Privacy
Our websites and products are not directed at children under 16, and we do not knowingly solicit personal information from children under 16.
